Summary
The Department exceeded its authority and violated applicable law and regulations when it entered into a multimillion-dollar Driver License Issuance Credential Replacement contract for a black and white license solution without a competitive procurement as required by the applicable procurement laws set.
The Department, specifically Goodwin, contends that the Department conducted a best value procurement, but it is undisputed that the Department issued a written request for quote to only one vendor, received only one vendor’s response and awarded a contract, started performing, and made payment without any public notification of award. Furthermore, the Department has made payment of at least over $1 million dollars under that unlawful contract without receiving the performance contractually required for that payment. This unlawful contract requires performance that is specifically in violation of North Carolina law as it procures black and white driver’s license photographs when North Carolina statutes require color photographs. Performance under this clearly unauthorized and ultra vires contract must be stayed during the pendency of this matter as that is in the best interest of all parties involved, particularly the taxpayers of North Carolina.
